Burnley: two live selective licensing designation groups
Burnley has two live selective licensing designation groups: Burnley Wood with Healey Wood and Leyland Road until 20 July 2027, and Trinity, Queensgate, Gannow, Daneshouse and Stoneyholme, and Padiham until 26 April 2030. Mandatory HMO licensing applies separately to five or more people from two or more households sharing facilities.
Check the selective map as well as the ward name
The first live selective designation covers Burnley Wood with Healey Wood and Leyland Road from 21 July 2022 to 20 July 2027. The second covers Trinity, Queensgate, Gannow, Daneshouse and Stoneyholme, and Padiham from 27 April 2025 to 26 April 2030. Each privately rented property in a designated area needs its own licence, subject to statutory exemptions; use the council's current street list and maps for an address check.
Mandatory licensing remains separate
Burnley requires a mandatory HMO licence where five or more people from two or more households share kitchen, bathroom or toilet facilities, regardless of storeys. The mandatory page says purpose-built apartment blocks containing three or more apartments do not need a mandatory HMO licence. A three- or four-person HMO may nevertheless need a selective licence in a designated area.
Fees vary by designation and history
For Burnley Wood, Healey Wood and Leyland Road, the displayed selective fee is £715 for a landlord without a previous Burnley selective licence or £640 for a previous licence holder. For the second designation group, the displayed fee is £750 or £670 respectively. Qualifying Good Landlord and Agent Scheme members receive a 30% Part B discount. A separate £100 early-application reduction appears in 2026 consultation material and is not an adopted fee.
Applications and exemptions
Applications use Burnley's external council-linked property checker and application portal. The selective FAQ lists exemptions including local-authority and registered-social-provider properties, holiday lets, commercial lettings, qualifying family-member lettings, certain long registered leases and properties covered by a TEN. A separate current TEN duration was not confirmed.
Penalty figures conflict across official pages
Burnley's current pages do not give one safe universal maximum: the selective page says up to £30,000, the selective FAQ and mandatory page use £40,000 wording, and an older RRO page mentions fines as high as £20,000. These figures should not be collapsed into one penalty cap. The council describes prosecution, financial penalties, rent repayment orders and management orders.
Planning and proposed changes
Burnley's confirmed HMO Article 4 direction covers Bank Hall, Brunshaw, Daneshouse with Stoneyholme, Gannow, Gawthorpe, Queensgate, Rosehill with Burnley Wood, Rosegrove with Lowerhouse and Trinity. It was confirmed on 19 June 2024 and took effect on 14 October 2024. A consultation from 3 August to 18 October 2026 proposes redesignating the first group and adding Lyndhurst Road; it is not current law.
