Calderdale: mandatory HMO licensing with unit-band fees
Calderdale requires a mandatory HMO licence for five or more people from two or more households sharing amenities. Licences last up to five years, are not transferable and need a separate application for each property. The council publishes unit-band fees and a concise but non-definitive public register.
The mandatory route
Calderdale's current guidance covers bedsits, shared houses and flats, hostels, non-holiday B&Bs, student accommodation and some section 257 HMOs. Mandatory licensing applies at five or more people from two or more households sharing amenities. Each property needs its own licence, which can last up to five years but may be shorter.
Licences do not transfer
Calderdale states that HMO licences are not transferable. Applications are available for new licences, renewals within thirty days of expiry and variations involving occupancy, layout or licence-condition changes. The council warns that demand is high and processing may be delayed, so keep the expiry date visible.
Fees scale by units
The published table displays a new total of £989.12 and renewal total of £703.12 for five to nine units. The bands rise to £1,070.96 and £784.96 for ten to nineteen, £1,152.80 and £866.80 for twenty to twenty-nine, £1,234.64 and £948.64 for thirty to thirty-nine, and £1,316.48 and £1,030.48 for forty or more. The table does not expose a clear effective date.
The concise register is not definitive
Calderdale publishes a concise HMO register through Dataworks and says it is periodically updated, contains only part of the full register and is not definitive. The full register is available by appointment. Use the council's register and licensing team together when checking a property or buying an HMO.
Enforcement and rent repayment
Operating an unlicensed HMO is a criminal offence. Calderdale may use a formal caution, a civil penalty of up to £30,000 or prosecution; prosecution may bring an unlimited fine and costs. The council also refers to rent repayment orders of up to twelve months, possible Rogue Landlords Database entry and the inability to use a section 21 notice while the property is unlicensed.
Local designation and planning status need confirmation
No current additional or selective designation was confirmed, and a Calderdale-specific HMO Article 4 direction was UNVERIFIED - could not confirm on council website. The current page says planning consent may be needed and building-regulations approval is required. A local TEN process was also unverified.
